1. Acceptance of Terms

By accessing or using the Consentify platform, including the website at getconsentify.com, the iOS application, and related services (collectively, the "Service") operated by Consentify LLC ("Consentify," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

Consentify provides a digital consent form platform for businesses, including:

• Digital form creation with drag-and-drop builder and AI-powered import.
• Client intake form submission with electronic signatures.
• PDF generation, email/SMS confirmations, and cloud storage.
• QR code-based contactless form signing.
• Before/after photo documentation and progress notes.
• Multi-tenant team management with role-based access.

3. Account Registration

To use the Service, you must create an account with accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activity that occurs under your account.
• Notifying us immediately of any unauthorized access.

You must be at least 18 years old to create an account.

4. Subscription Plans and Payment

4.1 Plans

The Service is offered under the following plans:

• Essential: Limited features, 1 form template, single user.
• Elevate ($9.99/month): 5 form templates, single user, AI form import, custom branding.
• Elite ($19.99/month): 15 form templates, up to 3 employees, AI assistant, priority support.
• Empire ($39.99/month): Unlimited forms and employees, all features included.

4.2 Billing

Paid subscriptions are billed monthly through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. You may cancel at any time; cancellation takes effect at the end of the current billing period.

4.3 Refunds

Payments are non-refundable except where required by applicable law. If you believe you were charged in error, contact us within 30 days at support@getconsentify.com.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Upload malicious code, viruses, or any harmful content.
• Attempt to gain unauthorized access to the Service or other accounts.
• Interfere with the security or integrity of the Service.
• Scrape, crawl, or use automated means to access the Service without permission.
• Collect personal data of others through the Service except as authorized by those individuals.

6. Your Data and Content

6.1 Ownership

You retain all ownership rights to the data and content you submit through the Service ("Your Content"). We do not claim ownership of Your Content.

6.2 License

You grant Consentify a limited, non-exclusive license to use, store, and process Your Content solely for the purpose of providing the Service to you.

6.3 Responsibility

You are solely responsible for Your Content, including ensuring you have obtained proper consent from individuals whose data you collect through the Service. You must comply with all applicable privacy laws and regulations.

7. Healthcare Providers

Consentify is HIPAA compliant, with AES-256 encryption, immutable audit trails, and role-based access controls. Healthcare providers can enter into a Business Associate Agreement (BAA) on the Elite and Empire plans, signed electronically in the app (Settings > Legal). Questions: support@getconsentify.com.

8. Intellectual Property

The Service, including its design, code, features, and branding, is owned by Consentify LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONSENTIFY LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Consentify LLC, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. You may export your data before termination by contacting support. We will retain your data for 30 days after termination before permanent deletion.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in New Jersey.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
